DOT Adjusts Civil Penalties for Hazmat Violations
|

Recently, the U.S. DOTs Pipeline and Hazardous Materials Safety Administration (PHMSA) published a final rule adjusting the maximum and minimum civil penalties for violations of the hazardous materials transportation regulations [74 FR 68701]. The new penalty amounts are effective on December 31, 2009 and apply to any violations occurring on or after January 1, 2010.
Under the new rule, the civil penalties are adjusted as follows:

Standard maximum $55,000 per day, per violation (was $50,000/day/violation) |

Maximum, if violation results in death, serious illness, severe injury, or substantial property damage $110,000 per day, per violation (was $100,000/day/violation) |

Standard minimum $275 per day, per violation (was $250/day/violation) |
| · |
Minimum, for violations related to training $495 per day, per violation (was $450/day/violation) |
The Federal Civil Penalties Inflation Adjustment Act of 1990, as amended by the Debt Collection Improvement Act of 1996 requires all Federal rulemaking agencies to adjust their civil penalties every four years for inflation [28 U.S.C. 2461]. This adjustment, which is spelled out in the law, is made based on a cost-of-living adjustment that is determined by the Consumer Price Index for the month of June in the year in which the adjustment is made. The final amount is then rounded as specified in the law.
The hazmat transportation civil penalties were last adjusted in 2005 based on the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETY-LU). The hazmat transportation law established both maximum and minimum civil penalty amounts, which are incorporated into the rules at 49 CFR Parts 107 and 171.
